Do you need a permit for a deck in Raleigh?
Raleigh has a specific residential permit process for constructing a deck, screened porch, or balcony. Applicants are directed to complete a Residential Permit Application and provide a site plan showing the proposed work on the property.[1]
A deck project may involve several types of review:

What is a deck permit site plan?
A deck site plan is a scaled overhead drawing showing how the proposed deck fits on the property.
It is different from the structural deck plans:
- Site plan: Shows where the deck and stairs will be located on the lot.
- Framing plan: Shows joist direction, spacing, beams, girders, posts, spans, and structural dimensions.
- Foundation plan: Shows the footing, pier, post, or foundation locations and sizes.
- Elevations: Show the deck height, stairs, guards, handrails, grade, roof, and exterior appearance.
- Construction details: Show the ledger attachment, flashing, connectors, fasteners, lateral-load connections, and other structural components.
A site plan does not replace the structural drawings. Its primary purpose is to explain the project’s placement and its relationship to the complete property.

What should a Raleigh deck site plan show?
The City instructs deck applicants to provide a site plan indicating the proposed work. Raleigh also recommends using its Residential Tier One Site Plan Checklist as a guide when preparing the submission.[1]
1. Property boundaries and lot dimensions
Show the complete property boundary, including:
- Front property line
- Rear property line
- Left-side property line
- Right-side property line
- Lot width and depth
- Irregular boundary segments where applicable
Deck setbacks should be measured from the legal property lines—not automatically from a fence, hedge, driveway, sidewalk, curb, or tree line.
These visible features may not follow the recorded property boundary. When the property corners cannot be established from reliable documents or monuments, a North Carolina licensed land surveyor may be needed.

2. Existing house footprint
Show and label the complete footprint of the existing house.
The plan should identify the wall where the deck will connect and show relevant features such as:
- Exterior door leading onto the deck
- Nearby windows
- Existing porches and landings
- Bay windows and projections
- Attached garages
- Roof overhangs
- Basement entrances
- Mechanical equipment
- Existing stairs and walkways
Showing only the rear wall can make it difficult to evaluate how the deck relates to the rest of the house and property.
3. Proposed deck footprint
Draw the complete deck platform and label it as proposed.
Include:
- Overall deck length
- Overall deck width
- Shape of the platform
- Distance from the deck to the house corners
- Any multiple levels or step-down sections
- Built-in benches or permanent features where relevant
- Deck height above the surrounding grade
For an L-shaped, wraparound, curved, or multi-level deck, provide enough individual dimensions to define the complete footprint.
4. Setbacks to property lines
Show separate measurements from the closest part of the deck to every relevant property line.
These may include:
- Rear-yard setback
- Left-side setback
- Right-side setback
- Primary-street setback
- Side-street setback on a corner lot
- Distance to an alley or right-of-way
Do not show only one setback. A rear deck may comply with the rear requirement while extending too close to a side or street-facing boundary.
5. Complete stair footprint
The stairs should appear on the site plan—not only on the construction drawings.
Show:
- The side of the deck containing the stairs
- The direction in which the stairs descend
- Approximate stair width
- Length of the stair flight
- Intermediate landings where applicable
- Bottom landing location
- Where the stairs meet finished grade
- Setback from the stairs to the property line
A stair flight can project several feet beyond the platform. A deck that appears to fit comfortably may become noncompliant once the full stairs and landing are included.
6. Existing accessory structures
Show existing structures and major improvements, including:
- Detached garages
- Carports
- Sheds
- Gazebos
- Pergolas
- Pools and spas
- Retaining walls
- Existing decks and patios
- Outdoor kitchens
These features may affect available yard space, construction access, drainage, impervious-surface calculations, and the practical location of the stairs.
7. Street and right-of-way information
Label all adjoining streets and rights-of-way.
On a corner lot, show both street frontages. Raleigh’s rules distinguish between the primary street and side street, and those classifications can affect the available setback area.
The public sidewalk, curb, and pavement edge should not automatically be treated as the property or right-of-way line.
8. Easements and utilities
Show recorded or known easements that affect the project area.
Common examples include:
- Drainage easements
- Public utility easements
- Sewer easements
- Waterline easements
- Access easements
- Greenway easements
- Private utility corridors
Deck footings should not be placed inside an easement without confirming that construction is allowed.
Also identify known utility features such as:
- Water meter
- Sewer cleanout
- Storm drain inlet
- Manhole
- Utility pole
- Overhead lines
- Underground service routes
- HVAC equipment
9. Septic system and private well
When a property is served by an onsite wastewater system, Raleigh requires Wake County review of the proposed deck or porch footprint.
The deck may not interfere with:
- Septic tank
- Drain field
- Wastewater repair area
- Private well
- Required separation distances
The City states that the site plan must be approved by Wake County when the property uses an onsite wastewater system.[1]
10. Drainage and environmental features
Show known site features that could affect stormwater review, including:
- Drainage easements
- Streams and riparian buffers
- Flood hazard areas
- Flood-prone soils
- Stormwater infrastructure
- Existing drainage swales
- Retaining walls
- Low areas near the house
Raleigh Stormwater asks for existing site conditions, proposed changes, existing and proposed impervious-surface calculations, and known streams, floodplains, and easements to be shown on the survey or plot plan.[3]
11. North arrow, scale, and project labels
Include:
- North arrow
- Graphic or written scale
- Property address
- Drawing date
- Clear existing and proposed labels
- Readable dimensions
All information should remain legible when the drawing is saved as a PDF and uploaded through Raleigh’s Permit and Development Portal.
Raleigh deck setback requirements
A deck does not always need to remain behind the same setback line as the main wall of the house.
Raleigh’s Unified Development Ordinance contains specific setback encroachments for decks, porches, patios, terraces, and stoops.[2]
Decks more than one foot above grade
A porch, deck, patio, terrace, or stoop more than one foot above grade may generally:
- Extend up to 12 feet into a required side or rear setback; and
- Extend up to 9 feet into a required primary-street or side-street setback.
However, the structure must generally remain at least:
- 3 feet from a side or rear property line; and
- 3 feet from a street property line.
These are encroachment rules—not universal deck setbacks. The actual available deck area depends on the principal building setback that applies to the specific property.
Decks one foot or less above grade
Raleigh’s UDO states that patios, terraces, and decks one foot or less above grade may generally be constructed:
- At least 0 feet from a side or rear property line; and
- At least 3 feet from a street property line.
This zoning allowance does not eliminate other restrictions. Easements, drainage features, utilities, building-code requirements, septic systems, overlays, and recorded property conditions can still affect the location.
How deck stairs affect the setback
The deck platform and the stairs are not always treated the same way under Raleigh’s setback-encroachment rules.
Raleigh’s UDO states that an unenclosed stairway may generally extend up to 4 feet into a required side or rear setback, provided that it remains at least 5 feet from the vertical plane of a property line.[2]
This can make stair direction an important design decision.
For example, stairs descending directly toward the rear boundary may not fit even where the main deck platform complies. Rotating the stairs so they run parallel to the house or property line may create a more workable layout.
Before finalizing the deck design, check:
- Distance from the platform to the boundary
- Full horizontal stair run
- Bottom landing depth
- Required distance from the stair to the property line
- Gate and walkway locations
- Existing patio or driveway
- Drainage route at the foot of the stairs
- Available headroom where stairs pass beneath another structure
Why stair details matter on the construction plans
The site plan shows the location and direction of the stairs. The structural plans and elevations should provide the construction details.
These commonly include:
- Total rise from grade to deck surface
- Number of risers
- Riser height
- Tread depth
- Stair width
- Stringer size and spacing
- Landing dimensions
- Handrail location
- Guard location
- Connection at the deck framing
- Support or footing at the bottom of the stairs
North Carolina’s currently effective building-code framework remains the 2018 North Carolina codes. Decks are specifically directed to the residential code’s wood-deck provisions, and the applicable amendments address stair guards, handrails, openings, and other safety details.[6][7]
Deck guards and handrails
The article illustration notes that a deck 30 inches or less above grade may not require a guard. This is a simplified visual note—not a complete code determination.
The permit reviewer will consider the actual vertical drop, nearby grade, stairs, landings, and other conditions.
Where guards are required, North Carolina’s residential-code amendments generally identify:
- A minimum guard height of 36 inches at open-sided walking surfaces
- A minimum stair-guard height of 34 inches measured from the stair nosings
- A handrail height generally between 34 and 38 inches
- Opening limitations intended to prevent passage through the guard
The exact guard and handrail design should be shown on the deck elevations and structural details rather than relying on a note placed only on the site plan.[7]
Covered decks, screened porches, and pergolas
Adding a roof changes the project significantly.
Raleigh specifically requires elevations for screened porches and any roofed structure, including covered decks and covered patios. The elevation drawings must show wall heights and grade levels, including average grade information.[1]
A roofed project may also affect:
- Principal-building setbacks
- Building coverage
- Impervious-surface calculations
- Footing and foundation design
- Roof drainage
- Structural loads

A deck intended to support a future screened porch, sunroom, or roof should be designed for the complete future load before construction begins.
Does a deck count as impervious surface?
Raleigh Stormwater asks residential applicants to list the deck separately in the existing and proposed impervious-surface calculations shown on the survey or plot plan.[3]
How the deck is ultimately classified can depend on its design and the surface beneath it.
Important factors may include:
- Spacing between deck boards
- Whether the deck is covered
- Whether the area below is concrete, gravel, soil, or landscaping
- Whether water can infiltrate naturally
- Whether gutters or downspouts concentrate runoff
- Whether a new patio is being installed beneath or beside the deck
Do not assume that every open deck contributes zero impervious surface or that every deck is counted the same way. Show the project accurately and allow the stormwater reviewer to determine the applicable treatment.
When a Lot Grading Plan may be required
Raleigh states that projects adding 800 square feet or more of impervious surface—or concentrating runoff into a channel, pipe, or downspout—must meet the City’s Lot Grading Plan requirements.[1]
Even a smaller project should avoid:
- Directing water toward a neighbouring property
- Blocking an established drainage swale
- Creating a low area beside the house
- Discharging a downspout onto a stair landing
- Covering a drainage inlet
- Placing footings inside a drainage easement
Lot layout and building coverage
The site plan should show the full property rather than presenting the deck as an isolated improvement.
A complete lot-layout review may consider:
- Existing house footprint
