Does a detached garage require a permit in Raleigh?

Yes. The City of Raleigh states that a permit is required regardless of the size of an accessory structure. Detached garages are specifically included in the City’s accessory-structure category.[1]

The type of permit generally depends on the structure’s dimensions:

  • Under 12 feet in every direction: Generally reviewed through a zoning permit.
  • Exceeding 12 feet in any direction: Generally reviewed through a building permit.

The City considers length, width, and height. Because most usable detached garages exceed 12 feet in at least one direction, they normally require a building permit with a complete plan set.

The City’s wording does not clearly describe every structure measuring exactly 12 feet. A project at that threshold should be confirmed with Raleigh Planning and Development before submission.

What reviews may apply?

A detached garage application may involve several City departments:

  • Zoning review: Garage placement, setbacks, size, height, building separation, and accessory-structure standards
  • Building review: Foundation, walls, roof framing, structural connections, fire protection, and construction details
  • Transportation review: Driveway access, curb cuts, sidewalk crossings, and work within the public right-of-way
  • Stormwater review: Impervious surface, drainage easements, streams, floodplain, overlays, and runoff
  • Historic review: Properties within a Raleigh Historic District or designated as a Raleigh Historic Landmark

What is a detached garage site plan?

A detached garage site plan is a scaled overhead drawing showing where the garage will be constructed in relation to the complete property.

It is different from the garage construction plans:

  • Site plan: Shows the garage location, setbacks, driveway, property lines, and surrounding site features.
  • Floor plan: Shows the garage dimensions, doors, windows, walls, rooms, and interior arrangement.
  • Foundation plan: Shows the slab, footings, foundation walls, piers, reinforcement, and dimensions.
  • Framing plan: Shows wall, ceiling, floor, and roof-framing information.
  • Elevations: Show the exterior appearance, garage-door openings, wall height, roof style, and finished grade.
  • Building section: Shows the foundation, floor, walls, insulation, roof, and construction materials.

Raleigh’s accessory-structure guidance calls for a site plan showing the proposed work, along with elevation drawings and structural plans. Plans must be drawn to an architectural scale and submitted with the application.[1]

What should a Raleigh detached garage site plan show?

The site plan should explain the complete property—not only the proposed garage. Reviewers need enough information to verify placement, access, setbacks, separation, utilities, drainage, and impervious-area compliance.

1. Property lines and lot dimensions

Show all legal property boundaries, including:

  • Front property line
  • Rear property line
  • Left-side property line
  • Right-side property line
  • Lot width and depth
  • Irregular boundary segments
  • Corner-lot or through-lot conditions

Garage setbacks should be measured from the legal boundaries—not automatically from:

  • A fence
  • A hedge or tree line
  • The driveway edge
  • A curb
  • A sidewalk
  • The edge of pavement
  • A drainage ditch

These visible features may not follow the property line. When the boundary location cannot be established from reliable records or monuments, a North Carolina licensed land surveyor may be required.

2. Existing house

Show and label the complete footprint of the existing house.

Include nearby features that may affect the proposed garage, such as:

  • Exterior doors and windows
  • Decks and stairs
  • Porches
  • Attached garage
  • Roof projections
  • Mechanical equipment
  • Basement entrances
  • Walkways and patios

The site plan should clearly distinguish the existing house from the proposed garage.

3. Proposed garage footprint

Draw the proposed garage in its intended location and label it clearly.

Include:

  • Overall exterior length
  • Overall exterior width
  • Garage-door location
  • Garage-door width
  • Pedestrian-door location where useful
  • Complete roof footprint
  • Roof overhangs
  • Maximum proposed height
  • Number of stories
  • Intended use

Where the garage includes storage, a workshop, an attic, plumbing, or an upper floor, the project description and construction plans should identify those features.

4. Setbacks to every property line

Show separate dimensions from the closest part of the garage to every relevant property boundary.

Depending on the property, this may include:

  • Rear-yard setback
  • Left-side setback
  • Right-side setback
  • Primary-street setback
  • Side-street setback on a corner lot
  • Distance to an alley
  • Distance to a future right-of-way line

Measure the setback to the closest applicable building element. Roof eaves, gutters, bay projections, stairs, and other features can extend beyond the garage wall.

5. Distance from the house and other structures

Raleigh’s UDO states that no accessory structure may be located closer than 6 feet to another building or structure on the same lot.[2]

The site plan should therefore show the distance from the proposed garage to:

  • The existing house
  • Existing shed
  • Carport
  • Gazebo or pergola
  • Pool house
  • Deck
  • Covered patio
  • Another detached garage

The article illustration shows a 10-foot building separation. A larger separation may certainly be used, but Raleigh’s general minimum is 6 feet unless another rule requires more.

6. Driveway and vehicle access

A detached garage must be connected to a practical vehicle-access route.

Show:

  • Existing driveway
  • Proposed driveway extension
  • Driveway width
  • Parking-pad dimensions
  • Garage-door orientation
  • Vehicle-travel direction
  • Street or alley access
  • Existing curb cut or driveway approach
  • Sidewalk crossing
  • Work proposed within the public right-of-way

Do not show a garage that cannot realistically be reached by a vehicle. Turning space, gates, retaining walls, trees, fences, utility poles, and narrow side yards can all affect access.

7. Streets, alleys, and rights-of-way

Label every adjoining street, alley, and public right-of-way.

Raleigh’s UDO requires an accessory structure to be at or behind the front wall of the house. Side-street setbacks also apply on corner lots.[2]

Where a garage is accessed from an alley, the UDO provides a special rule:

  • The general accessory-structure setback from an alley is at least 4 feet.
  • A garage’s vehicular opening facing an alley must be set back either 4 feet or 20 feet or more.

The gap between 4 feet and 20 feet is intentionally avoided so vehicles do not stop in an awkward position while entering or leaving the garage.[2]

8. Existing structures and improvements

Show all significant existing improvements, including:

  • Sheds
  • Carports
  • Decks
  • Pergolas and gazebos
  • Pools and spas
  • Patios
  • Retaining walls
  • Walkways
  • Outdoor kitchens
  • Existing parking areas

These features affect available building area, access, separation, drainage, and impervious-surface calculations.

9. Easements and utilities

Show recorded or known easements crossing the property.

These may include:

  • Public utility easement
  • Drainage easement
  • Sewer easement
  • Waterline easement
  • Access easement
  • Greenway easement
  • Private utility easement

Also identify known utility features where relevant:

  • Water meter
  • Sewer cleanout
  • Manhole
  • Storm drain inlet
  • Utility pole
  • Overhead electrical lines
  • Underground service lines
  • Existing well
  • Septic system

Garage foundations, slabs, driveways, and retaining walls should not be installed inside an easement without confirming that construction is permitted.

10. Drainage and stormwater features

Show known drainage conditions that may affect the garage.

Examples include:

  • Drainage swales
  • Storm drains
  • Catch basins
  • Drainage easements
  • Streams and riparian buffers
  • Floodplain boundaries
  • Flood-prone soils
  • Retaining walls
  • Low areas
  • Existing downspout discharge

The garage and driveway should not block an established drainage route or redirect concentrated runoff toward a neighbouring property.

11. North arrow, scale, and labels

Include:

  • North arrow
  • Graphic or written scale
  • Property address
  • Drawing date
  • Existing and proposed labels
  • Readable dimensions
  • Property-line labels
  • Street and right-of-way labels

All information should remain legible when the plan is converted to PDF and uploaded through Raleigh’s Permit and Development Portal.

Raleigh detached garage setback requirements

Accessory-structure setbacks in Raleigh depend primarily on the lot size and whether a boundary faces a street or alley.

The general residential accessory-structure standards are shown below.[2]

Additional general standards include:

  • The garage must generally be located at or behind the front wall of the house.
  • The garage must be at least 6 feet from another building or structure on the same lot.
  • The accessory-structure height limit is generally 26 feet.
  • The general alley setback is 4 feet.
  • A garage door facing an alley must generally be 4 feet or at least 20 feet from the alley.

For the 7,200-square-foot lot shown in the article illustration, the general accessory-structure side and rear setbacks would ordinarily fall within the 4,000-to-9,999-square-foot category: 5 feet from side and rear property lines. Other zoning conditions may still require more.

Do not copy the sample setbacks blindly: The 7.5-foot side setbacks and 20-foot rear-yard dimension in the illustration show how measurements can be presented. They are not the standard accessory-garage setbacks for every Raleigh property.

How much accessory-building area is allowed?

Raleigh also limits the combined floor area of accessory structures on a residential lot.

The UDO applies the smaller of two limits:

  • A maximum area based on the lot-size category; and
  • 50% of the principal structure’s floor area.

These maximums apply to all accessory structures on the lot combined. An existing shed, gazebo, workshop, carport, pool house, or second garage may reduce the area available for the new garage.[2]

Driveway access and permit requirements

A garage permit does not automatically approve every driveway change.

The City of Raleigh requires permits before installing or replacing a residential driveway. Work within the public right-of-way may also require a right-of-way permit and an appropriately qualified contractor.[5]

Separate review may be required when the garage project includes:

  • A new curb cut
  • A wider driveway approach
  • A relocated driveway
  • A new sidewalk crossing
  • Driveway replacement
  • Work within five feet of the right-of-way
  • A new front-yard parking pad
  • Changes to roadside drainage

The site plan should show both the private driveway and the public approach so reviewers can understand where the vehicle crosses the property line and right-of-way.

Driveway access from a rear alley

Where the garage is served by a rear alley, show:

  • Alley width
  • Property line adjoining the alley
  • Garage-door orientation
  • Distance from the garage door to the alley
  • Driveway or apron between the garage and alley
  • Utility poles, fences, retaining walls, and obstructions
  • Drainage direction

The garage door should not open into an arrangement that leaves a vehicle blocking the alley or unable to turn safely.

What is impervious area?

Impervious area—also called built-upon area in Raleigh’s stormwater rules—generally includes surfaces that prevent or significantly reduce rainwater from soaking into the soil.

Raleigh’s UDO defines built-upon area as impervious and partially impervious surfaces to the extent that they prevent infiltration. Asphalt, concrete, masonry, roofing materials, and similar surfaces are generally treated as 100% built-upon area.[7]

For a detached garage project, impervious area may include:

  • Existing house roof
  • Existing garage or shed roof
  • Proposed garage roof
  • Existing driveway
  • Proposed driveway extension
  • Parking pad
  • Concrete apron
  • Patio
  • Walkways
  • Other paved or compacted surfaces

What impervious calculations should the site plan include?

Raleigh Stormwater asks residential applicants to show existing and proposed impervious-surface calculations as separate line items on the survey or plot plan.[3]

A clear table may look like this:

The basic calculation is:

Impervious percentage = total impervious area ÷ lot area × 100

The project must be evaluated against the actual impervious limit applying to the property. The maximum can depend on zoning, subdivision records, watershed overlays, grandfathered status, development approvals, and other site-specific regulations.

Image clarification: The 40% figure shown in the sample graphic is not a universal Raleigh maximum. It also should not be confused with accessory-building floor-area limits. Building coverage, accessory floor area, and stormwater impervious area are related but separate calculations.

Why the driveway matters to impervious area

The garage roof is often only part of the added impervious surface.

A 24-by-24-foot garage has a 576-square-foot footprint. If the project also adds a 12-by-40-foot driveway extension, the new paved area adds another 480 square feet. The combined increase would be approximately 1,056 square feet before counting walkways, aprons, or patios.

This matters because Raleigh states that projects adding 800 square feet or more of impervious surface—or concentrating runoff through a channel, pipe, or downspout—must meet Lot Grading Plan requirements.[1]

The complete project should therefore be calculated, not only the garage building.

Drainage and grading considerations

A detached garage changes how rain and melting ice move across the property.

Before finalizing the site plan, consider whether the garage or driveway will:

  • Block an existing drainage swale
  • Direct runoff toward a neighbour
  • Create a low area between the house and garage
  • Send driveway water into the garage
  • Concentrate roof runoff through downspouts
  • Cover a storm drain or inlet
  • Conflict with a drainage easement
  • Change the grade near the street or alley
  • Increase erosion beside the driveway

Raleigh Stormwater reviews residential applications for impervious-surface compliance, riparian buffers, floodplain conditions, watershed overlays, and residential drainage easements.[3]

Known streams, floodplains, easements, and existing drainage infrastructure should appear on the site plan where they affect the property.

Can you submit a site plan without a survey?

Raleigh provides several site-plan options for minor permits:

  • An original signed and sealed survey showing the proposed work
  • An existing certified survey accompanied by a supplemental copy showing the proposed work
  • A site plan prepared without an existing survey for certain eligible projects

The no-existing-survey option is available for accessory structures no greater than 500 square feet and no taller than 15 feet. It must show property lines, streets, rights-of-way, existing and proposed improvements, and distances to property lines, streets, and rights-of-way.[4]

A typical detached garage larger than 500 square feet does not qualify for that option. Even when a smaller structure qualifies, City staff may still require an official survey after reviewing the property.

A survey is particularly likely to be needed when:

  • The garage is close to a property line
  • The boundary location is uncertain
  • An easement affects the building area
  • The lot contains a stream or riparian buffer
  • The property is within a flood hazard area
  • Recorded dimensions conflict with existing fences or improvements
  • The project includes a new driveway or vehicular surface

Historic properties, wells, and septic systems

Additional approvals may be required before Raleigh accepts the garage permit application.

Historic district or landmark

A property within a Raleigh Historic District or designated as a Raleigh Historic Landmark may require a Certificate of Appropriateness.

Historic review may consider:

  • Garage location
  • Visibility from the street
  • Size and height
  • Roof style
  • Exterior materials
  • Garage-door design
  • Relationship to the historic house
  • Changes to historic landscaping

Private well or septic system

Wake County Environmental Services approval is required before applying to Raleigh when the property contains private well or septic services.[1]

The site plan should show:

  • Septic tank
  • Drain field
  • Wastewater repair area
  • Private well
  • Required separation areas

A garage, driveway, slab, or foundation should not be placed over the septic system or required repair area.

What construction drawings may be required?

The site plan is only one part of the permit package.

A detached garage submission may also require:

  • Residential Permit Data Form when the structure exceeds 15 feet in height

Raleigh requires the complete plan set to be submitted as a PDF. Plans must be drawn to an architectural scale, with a minimum allowable scale of one-quarter inch equals one foot.[1]

Permit review may be delayed when the drawing does not explain the complete proposal.

  • Assuming a small garage does not require a permit
  • Showing only the garage and not the complete property
  • Providing only one property-line setback
  • Measuring from a fence instead of the legal boundary
  • Using the 7.5-foot and 20-foot sample dimensions without checking the UDO
  • Showing 10 feet as the required building separation instead of Raleigh’s general 6-foot minimum
  • Leaving the roof overhang off the site plan
  • Failing to show the garage-door orientation

  • Ignoring curb, sidewalk, and right-of-way work
