The City states that a permit is required regardless of the size of an accessory structure. The general accessory-structure process distinguishes between:

  • Structures under 12 feet in every direction: Generally processed as a zoning permit.
  • Structures exceeding 12 feet in any direction: Generally processed as a building permit.

The dimensions considered include the structure’s length, width, and height.[1]

The City’s wording does not clearly explain every project measuring exactly 12 feet. Homeowners with a pergola at the threshold should confirm the correct permit route with Raleigh Planning and Development before submitting.

How Raleigh may classify a pergola

Raleigh’s general permit page identifies gazebos, detached garages, carports, sheds, greenhouses, and pool houses as examples of accessory structures. Although the page does not list every possible pergola design, a freestanding pergola is typically closest to the accessory-structure category because it is subordinate to the house and located on the same lot.

The exact classification may change when the pergola is:

  • Attached directly to the house
  • Constructed over an elevated deck
  • Covered with a solid roof
  • Equipped with operable louvers
  • Enclosed with screens, windows, or walls
  • Designed as a covered porch or outdoor room
  • Connected to the house by a breezeway
  • Combined with an outdoor kitchen, fireplace, or utility installation

A pergola that is structurally attached to the dwelling may be reviewed differently from a detached accessory structure. Submit a clear description of the project rather than relying only on the word “pergola.”

What is a pergola site plan?

A pergola site plan is an overhead drawing showing where the proposed structure will sit on the property.

It is different from the pergola’s construction plans:

  • Site plan: Shows the pergola’s location in relation to the property lines, house, streets, easements, and other improvements.
  • Foundation or footing plan: Shows post locations, footing sizes, anchoring, and foundation details.
  • Framing plan: Shows columns, beams, rafters, louvers, and structural connections.

What should a Raleigh pergola site plan show?

The site plan should make the complete property arrangement easy to understand. Showing only the pergola without the surrounding lot normally does not provide enough information to verify placement.

1. Property lines and lot dimensions

Show the complete front, rear, and side property lines. Include the available lot dimensions and identify the shape of the parcel.

Pergola setbacks must be measured from the legal property boundaries—not automatically from:

  • A fence
  • A hedge or tree line
  • The edge of a patio
  • A driveway
  • A sidewalk
  • The edge of pavement
  • A drainage ditch

These visible features may not follow the recorded boundary. Where the property-line location is uncertain, a North Carolina licensed land surveyor may be needed.

2. Existing house

Show and label the complete footprint of the existing house.

The plan should identify the wall nearest the pergola and any relevant exterior features, including:

  • Doors and windows
  • Existing porches
  • Decks and stairs
  • Bay windows
  • Attached garages
  • Roof projections
  • Mechanical equipment

If the pergola will be attached to the house, clearly identify the connection point and show whether the overhead framing touches the house wall or roof.

3. Proposed pergola footprint

Draw the pergola in its proposed location and label it as new or proposed.

Include:

  • Overall length
  • Overall width
  • Post locations
  • Distance between posts where useful
  • Full overhead-frame or roof footprint
  • Maximum proposed height
  • Whether it is attached or freestanding
  • Whether the roof is open, slatted, louvered, or solid

Do not dimension only the inside seating area. The permit drawing should represent the pergola’s complete exterior footprint.

4. Setbacks to every relevant property line

Show separate measurements from the pergola to the rear, left-side, right-side, and street-facing property lines where applicable.

Measure to the closest part of the structure. Depending on the design, this may be:

  • The outer face of a post
  • The edge of a beam
  • The end of a rafter
  • The roof or louver projection
  • A gutter or overhang

5. Distance from the house and other structures

Show the distance between the proposed pergola and the house, garage, shed, pool house, gazebo, deck, or other nearby structure.

Raleigh’s UDO generally states that an accessory structure may not be located closer than 6 feet to another building or structure on the same lot.[2]

This separation rule is especially important for a freestanding pergola placed close to the rear wall of the house. A structure that does not maintain the required separation may be considered attached or may require a different review.

6. Patios, decks, stairs, and outdoor kitchens

Show any patio, deck, landing, stairway, fire pit, fireplace, grill island, or outdoor kitchen associated with the pergola.

These elements can affect:

  • Building separation

9. Fences and retaining walls

Show existing and proposed fences and retaining walls near the pergola.

10. Trees and environmental features

Show significant trees or protected site features where they affect pergola placement.

  • Stormwater infrastructure

These features may restrict where posts, patios, grading, or other improvements can be installed.

11. North arrow, scale, and labels

Include a north arrow, graphic scale, drawing date, property address, and clear labels distinguishing existing and proposed improvements.

Raleigh’s Tier One checklist calls for the north arrow at the top of the plan, a graphic scale, adjoining rights-of-way, property-boundary information, and clearly labelled existing and proposed development.[4]

Raleigh pergola setback requirements

There is no single setback that applies to every Raleigh pergola.

For detached accessory structures associated with houses in residential districts, Raleigh’s UDO provides the following general standards.[2]

Additional general rules include:

  • The accessory structure must generally be located at or behind the front wall of the house.
  • A minimum 4-foot setback generally applies from an alley when the structure does not contain parking.
  • The UDO generally allows a maximum accessory-structure height of 26 feet, although permit type, residential infill rules, overlays, building code, and the specific design may impose additional requirements.
  • A structure with no more than 150 square feet of gross floor area and no more than 10 feet in height generally requires at least 5 feet from side and rear property lines.

Can a pergola be placed in the front yard?

Raleigh’s accessory-structure table generally requires an accessory structure to be located at or behind the front wall of the house.[2]

A freestanding pergola proposed in front of the house may therefore be difficult to approve under the normal accessory-structure standards.

Different rules may apply to:

  • An attached entrance feature
  • A small architectural trellis
  • A permitted porch or portico
  • A property with unusual street orientation
  • A corner lot
  • A site with an approved variance

Do not assume that the principal house’s front setback automatically establishes an acceptable pergola location.

Pergolas on corner lots

The side of the property that feels like a backyard may legally be a street-facing yard. This is one reason the site plan should identify:

  • Both street names

  • The side street
  • The front wall of the house

Corner-lot placement should be checked before purchasing a pergola kit because a structure may fit physically while failing the street-side setback.

Measure the full pergola—not only the posts

Pergolas commonly have rafters, beams, louvers, or roof panels extending beyond their supporting columns.

If the posts are 5 feet from the property line but the overhead frame projects another 18 inches, the closest structural element is only 3 feet 6 inches from the boundary.

Raleigh’s UDO permits certain building features, including eaves and roof overhangs, to encroach into required setbacks under specific conditions. Such features generally must remain at least 3 feet from the vertical plane of a property line.[6]

Whether a pergola beam, rafter, louver, canopy, or gutter qualifies for a particular encroachment depends on the design and City interpretation. The safest site plan approach is to show:

  • The post-to-post dimensions
  • The complete overhead-frame dimensions
  • The length of each projection
  • The setback to the closest part of the structure

Attached pergolas require extra care

An attached pergola can affect more than zoning placement.

The permit reviewer may need information about:

  • How the pergola connects to the house
  • Whether the wall or roof carries structural loads
  • Flashing and water protection
  • Existing wall framing
  • Footing and foundation design
  • Roof drainage
  • Doors and windows beneath the structure
  • Electrical fixtures, fans, or receptacles

A pergola connected by a breezeway may remain detached only when the breezeway meets Raleigh’s dimensional, height, openness, location, and setback standards. Otherwise, the two structures may be treated as one attached principal structure.[2]

Clearly identify the attachment method in the project description and construction plans.

Does a pergola affect impervious surface?

The answer depends on the complete project.

An open-slatted pergola over existing grass may be treated differently from:

  • A pergola over a new concrete patio
  • A solid-roof pavilion
  • A louvered roof designed to shed water
  • A structure with gutters and downspouts
  • A pergola over pavers installed on an impervious base
  • An outdoor kitchen with additional hardscape

Raleigh Stormwater asks residential applicants to show existing and proposed impervious-surface calculations as separate line items, including items such as houses, driveways, sheds, decks, and patios. Known streams, floodplains, and easements should also appear on the survey or plot plan.[5]

Projects adding 800 square feet or more of impervious surface—or concentrating runoff into a channel, pipe, or downspout—must meet Raleigh’s Lot Grading Plan requirements.[1]

Even a smaller pergola project can create drainage problems when a new patio or solid roof directs water toward:

  • A neighbouring property
  • The house foundation
  • A low area in the yard
  • A retaining wall
  • A fence line
  • A drainage easement

Can you submit a site plan without a survey?

For certain minor projects, Raleigh provides a site-plan option when the homeowner does not have an existing survey.

The City states that this option may be used for accessory structures that are:

  • No greater than 500 square feet; and
  • No greater than 15 feet tall.

The site plan must show property lines, adjacent streets, rights-of-way, existing improvements, proposed improvements, and distances from improvements to property lines, streets, and rights-of-way. Known easements and utility-related features must also be identified.[3]

City staff will determine during the initial review whether the drawing is sufficient or whether a signed and sealed survey is still required.

A survey may be particularly important when:

  • The pergola is close to a property line
  • The property boundaries are uncertain

A pergola on property located in a Raleigh Historic District or designated as a Raleigh Historic Landmark may require a Certificate of Appropriateness before the permit application can proceed.[1]
